So pretty please with sprinkles on the top, stop using my\u00c2\u00a0 f\u00e2\u20ac\u2122king image.<\/p>\n<p>THE INTERNET: But I found it on the internet.<\/p>\n<p>ME: As I said, I don\u00e2\u20ac\u2122t want to be a dick &#8211; just stop using my image!<\/p>\n<p style=\"color: #1d2129;\">48hrs later!<\/p>\n<p style=\"color: #1d2129;\">THE INTERNET: HEY!!!\u00c2\u00a0 Why have I got a solicitor letter charging me $1600 for copyright Infringement?<\/p>\n<p style=\"color: #1d2129;\">ME:\u00c2\u00a0 Because you were a dick and didn\u00e2\u20ac\u2122t stop using my image.<\/p>\n<p style=\"color: #1d2129;\">THE INTERNET: But that\u00e2\u20ac\u2122s not fair!<\/p>\n<p style=\"color: #1d2129;\">ME: I know, it sucks!<\/p>\n<p style=\"color: #1d2129;\">So this is what it has come to!\u00c2\u00a0 Legal action against anyone infringing my copyright.\u00c2\u00a0 It sucks! If someone is permitted to just grab an image off a google search (in this case the image was lifted straight from teamrock.com) and use it, then why would anyone pay a music photographer ever again? Why would they when they can get it for free?\u00c2\u00a0 If that is allowed to happen then Professional Photography for me is no longer a viable career.\u00c2\u00a0 As I said, I don\u00e2\u20ac\u2122t want to be a dick but if a commercial company use my image without permission then they will be pursued for compensation. For the sake of this industry I have to start enforcing some control or it\u00e2\u20ac\u2122s game over!\u00c2\u00a0 Obviously professional photography will still exist, you can\u00e2\u20ac\u2122t google search your own wedding pictures or corporate headshots.\u00c2\u00a0 I am talking about Music Photography in my case.<\/p>\n<p style=\"color: #1d2129;\"><img loading=\"lazy\" decoding=\"async\" #1d2129;\">It is now easier than ever to monitor illegal use.\u00c2\u00a0 The company that host my website constantly image search every single photograph on my website looking for copyright infringement and alert me every few days of sightings.\u00c2\u00a0 Once alerted I can either dismiss a sighting or activate proceedings against them with a simple click.\u00c2\u00a0 The majority of illegal sightings are just fans of music or photography and they do not concern me.\u00c2\u00a0 But a commercial website that has pay per click advertising will be pursued for payment.<\/p>\n<p has it come to this?\u00c2\u00a0 Why is the internet not protecting photographers image rights?\u00c2\u00a0 The social networks have played a big part in undermining photographers by stripping away the encoded Metadata that identifies the owner of an image.\u00c2\u00a0 Facebook completely remove all data within the image.\u00c2\u00a0 Why?\u00c2\u00a0 Because it ensures that there is no come back of ownership rights when an image is used on their platform.\u00c2\u00a0 It protects them from any legal blame as the authors identity is removed as soon as it is uploaded.\u00c2\u00a0 Facebook have also made it as difficult as possible to report copyright infringement. \u00c2\u00a0That said I enjoy using social media for networking and displaying my work despite of its shortcomings.<\/p>\n<p media isn\u00e2\u20ac\u2122t the problem though.\u00c2\u00a0 It is the lack of value and the irrelevance of the owner of an image that is the issue.\u00c2\u00a0 Those seeds were sown by the picture agencies when the internet was just starting to blossom.<\/p>\n<p style=\"color: #1d2129;\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-1520\" src=\"http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/COPYRIGHT-BLOG-2-660x376.jpg\" alt=\"COPYRIGHT BLOG 2\" width=\"640\" height=\"364\" srcset=\"http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/COPYRIGHT-BLOG-2-660x376.jpg 660w, to make a secondary income from syndication, where a reputable photo agency would shotgun physical copies of images to publications throughout the world.\u00c2\u00a0 The agency would take a cut of 40% of any sales but it was usually profitable because they would sell the images for magazine front covers\/features in territories that we had little contacts.\u00c2\u00a0 On a monthly basis earnings were as much as \u00c2\u00a31000 or as little as \u00c2\u00a3100 from selling on the images from previous magazine commissions.\u00c2\u00a0 Not bad when you have already been paid once for doing the work 3 months earlier. As the internet began to develop more and more sales were to websites instead of the lucrative physical publications.\u00c2\u00a0 The earnings from syndication rapidly decreased because the internet wasn\u00e2\u20ac\u2122t given any value by the publishers or by the picture agencies.\u00c2\u00a0 All of a sudden the photo agency had most of their work done for them which probably helped as their revenue had declined drastically.\u00c2\u00a0 No longer did they have to make physical copies of images and courier them all over the world &#8211; I knew several photo agencies that employed their own motorbike couriers.\u00c2\u00a0 The images were put online and clients could download at their leisure.\u00c2\u00a0 Because this whole process was simplified the photo agency saved a massive amount of expense.\u00c2\u00a0 People were let go.\u00c2\u00a0 You no longer needed to run and maintain an E6 transparency process, you didn\u00e2\u20ac\u2122t need couriers and you didn\u00e2\u20ac\u2122t need the huge amount of staff that were required to organise the distribution and selling of images.\u00c2\u00a0 The news photographers no longer had to process in the middle of the night and deliver as soon as humanly possible.<\/p>\n<p style=\"color: #1d2129;\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-1528\" src=\"http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/a7x3-660x495.jpg\" alt=\"a7x3\" width=\"640\" height=\"480\" srcset=\"http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/a7x3-660x495.jpg 660w, http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/a7x3-300x225.jpg 300w, http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/a7x3.jpg 960w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/p>\n<p style=\"color: #1d2129;\">The photographers were given secure log-in information and could upload seconds after an event had finished.\u00c2\u00a0 The entire operation was simplified and made faster, easier and cleaner.\u00c2\u00a0 In theory the photo agency was given a golden ticket to control the market place.\u00c2\u00a0 They had the contacts, the technology, the infrastructure and most importantly the images. But instead, the revenue being made by the agencies crashed like a bad day in the stock exchange.\u00c2\u00a0 Why?\u00c2\u00a0 Because the agencies didn\u00e2\u20ac\u2122t know how to deal with the internet.\u00c2\u00a0 Pricing was always negotiated on how and where an image was to be used.\u00c2\u00a0 What was the territory, readership, was it a full page, half page, a small insert etc?\u00c2\u00a0 A front cover of a book was priced more than a single small image being used for a review on page 20 of a newspaper.\u00c2\u00a0 Each image sale was priced accordingly.\u00c2\u00a0 The internet was the unknown entity.\u00c2\u00a0 The photo agencies at first saw the internet as a new secondary market which was an opportunity to get extra revenue.\u00c2\u00a0 If an image was sold to a magazine for \u00c2\u00a380 for a live review, then an extra \u00c2\u00a314 was made for publishing it on the magazines website.\u00c2\u00a0 \u00c2\u00a314 isn\u00e2\u20ac\u2122t a lot of money but it was on top of earnings they were getting anyway so it was seen as a bonus.\u00c2\u00a0 But it didn\u00e2\u20ac\u2122t take long for the magazine to realise if they only published the review online they could save \u00c2\u00a380 and only pay the \u00c2\u00a314 for usage online.\u00c2\u00a0 The magazine or newspaper would generate huge amounts of internet traffic to their site and promote the physical copy and only have to pay a minimal fee for a good picture. This should have been the moment when the photo agencies said STOP!<\/p>\n<p style=\"color: #1d2129;\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-1521\" src=\"http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/MATT-AVENGED-660x439.jpg\" alt=\"MATT AVENGED\" width=\"640\" height=\"425\" srcset=\"http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/MATT-AVENGED-660x439.jpg 660w, http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/MATT-AVENGED-300x199.jpg 300w, http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/MATT-AVENGED.jpg 2000w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/p>\n<p style=\"color: #1d2129;\">Some of the agencies\u00c2\u00a0tried to negotiate but the majority decided that quantity sales would make up for the loss of revenue and left the pricing for web use unchanged.\u00c2\u00a0 It didn\u00e2\u20ac\u2122t help that one famous photo agency began to buy up all the smaller agencies and monopolised the market.\u00c2\u00a0 For as little as \u00c2\u00a36, a publication could now get access to an image from an event that had just taken place.\u00c2\u00a0 This meant the photographer who took the pictures would be earning less than \u00c2\u00a33 for shooting that event.\u00c2\u00a0 Did I forget to mention that the 60\/40% split of earnings had tipped the other way to 60% to the agency and only 40% for the photographer.\u00c2\u00a0 The internet had gone from being just an extra bit of earnings to the main operator.\u00c2\u00a0 It was no longer just a weird portal with a bit of content, it was now the main event with millions visiting individual sites on a daily basis.\u00c2\u00a0 That photograph that you earn\u00e2\u20ac\u2122t \u00c2\u00a33 for was now also being shared by millions of users on social networks.\u00c2\u00a0 Once an image \u00e2\u20ac\u02dcgoes viral\u00e2\u20ac\u2122 there is no turning back.\u00c2\u00a0 You can\u00e2\u20ac\u2122t whine at the operator of a social platform.\u00c2\u00a0 They can\u00e2\u20ac\u2122t control what their users do and the photographer gets nothing in compensation.\u00c2\u00a0 If the agencies had put more value and control over the distribution of images then they would have kept some value to the images.\u00c2\u00a0 Instead the biggest agency put their entire network available for free for non-commercial use.\u00c2\u00a0 Thus undermining any commercial sites willingness to pay.\u00c2\u00a0 Why would they pay if everyone else can use for free!?<\/p>\n<p style=\"color: #1d2129;\"><a title=\"JOHN McMURTRIE666 INSTAGRAM\" href=\"https:\/\/www.instagram.com\/johnmcmurtrie666\/\" target=\"_blank\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-1522\" src=\"http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/instagram-660x423.jpg\" alt=\"instagram\" width=\"640\" height=\"410\" srcset=\"http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/instagram-660x423.jpg 660w, http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/instagram-300x192.jpg 300w, http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/instagram.jpg 1962w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/a><\/p>\n<p style=\"color: #1d2129;\">I got out of the syndication market around 2006.\u00c2\u00a0 I could see what was happening and I gambled that it would be safer to hold on to my images as a valued commodity .\u00c2\u00a0 It is much easier and more profitable to deal with a publisher or company direct than go through an agency. I keep control on where my images are used and avoid embarrassing my clients by images turning up on tea towels and illegal merchandise.\u00c2\u00a0 I also produce occasional Limited Edition prints of stand out images.<\/p>\n<p style=\"color: #1d2129;\"><a title=\"Limited Edition Prints\" href=\"http:\/\/johnmcmurtrie.bigcartel.com\" target=\"_blank\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-1523\" src=\"http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/HIM-PRINTS-660x660.jpg\" alt=\"HIM PRINTS\" width=\"640\" height=\"640\" srcset=\"http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/HIM-PRINTS-660x660.jpg 660w, http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/HIM-PRINTS-150x150.jpg 150w, http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/HIM-PRINTS-300x300.jpg 300w, http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/HIM-PRINTS.jpg 960w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><\/a><\/p>\n<p style=\"color: #1d2129;\">I recently was asked to supply an image for a well known Guitar manufacturer.\u00c2\u00a0 I spent several hours picture editing and re-touching a suitable image and was told it was for a global marketing campaign.\u00c2\u00a0 I quoted a reasonable amount for the company to use the image and that is when the fun started!\u00c2\u00a0 Their marketing director pointed out that they were using the image for an online campaign first and the printed advertisement\u00c2\u00a0 would be in guitar magazines \u00e2\u20ac\u02dcat some point\u00e2\u20ac\u2122 later that year.\u00c2\u00a0 Because they would only be publishing online first, they hoped a credit would suffice instead of payment for now. \u00c2\u00a0 A credit? I won\u00e2\u20ac\u2122t do the usual rant about a credit won\u00e2\u20ac\u2122t pay for cameras, mortgages etc, but it is safe to say a credit isn\u00e2\u20ac\u2122t compensation for putting a valuable image out on the internet on the promise of payment at a later stage. \u00c2\u00a0I politely declined the offer of a credit and stuck to my guns on the initial quote stating my reasons why.\u00c2\u00a0 An advert in a UK guitar mag will be seen by approximately 10,000 people, an advert published online will be seen worldwide by their 5 million Facebook followers and one million followers on Twitter!\u00c2\u00a0 Not to mention the viral aspect to the advert being shared and retweeted online.\u00c2\u00a0 So what is the thought process to an image having more value in print than online?\u00c2\u00a0 The value of anything is only what someone is prepared to pay for it?\u00c2\u00a0 A poor quality photograph has less value than a good one.\u00c2\u00a0 There is a reason us Professionals are still in work.\u00c2\u00a0 If you see an image and say \u00e2\u20ac\u02dcWOW!\u00e2\u20ac\u2122 then the photographer has done his job.\u00c2\u00a0 Equally if an image makes you cry, laugh, get mad or moves you in some way then that image has value.\u00c2\u00a0 To put little or no value on an image just because it is \u00e2\u20ac\u02dconly\u00e2\u20ac\u2122 on the internet is nonsense!<\/p>\n<p style=\"color: #1d2129;\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-1515\" src=\"http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/jmc-ghost-spread.jpg\" alt=\"jmc ghost spread\" width=\"1\" height=\"1\" \/><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-1515\" src=\"http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2017\/05\/jmc-ghost-spread.jpg\" alt=\"jmc ghost spread\" width=\"1\" height=\"1\" \/><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-1394\" src=\"http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2014\/12\/foo-fighters-smoke-FB-495x660.jpg\" alt=\"foo fighters smoke FB\" width=\"495\" height=\"660\" srcset=\"http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2014\/12\/foo-fighters-smoke-FB-495x660.jpg 495w, http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2014\/12\/foo-fighters-smoke-FB-225x300.jpg 225w, http:\/\/www.picturedesk.co.uk\/news\/wp-content\/uploads\/2014\/12\/foo-fighters-smoke-FB.jpg 630w\" sizes=\"auto, (max-width: 495px) 100vw, 495px\" \/><\/p>\n<p style=\"color: #1d2129;\">Thankfully the print editions of our newspapers and magazines are still surviving and some are even thriving.\u00c2\u00a0 The New York Post recently concluded that exclusive content is key to success in the physical paper and the online editions.\u00c2\u00a0 Good photography and great writing is what keeps readers and generates more traffic.
